Traditionally, courts adjudicate fundamental rights cases by applying substantive tests of reasonableness or proportionality. Increasingly, however, European courts are also expressly taking account of the quality of the procedure that has led up to a fundamental rights interference. There still is a lack of clarity as to what 'procedural review' really means, what its potential for judicial decision-making is, how it relates and should relate to substantive review, and what its limitations are. Over Janneke Gerards

Janneke Gerards is hoogleraar fundamentele rechten aan de Universiteit Utrecht. Zij voert haar onderzoek uit in het kader van het universitaire onderzoekszwaartepunt Instituties voor Open Samenlevingen en het facultaire Montaigne Centrum voor Rechtsstaat en Rechtspleging. Haar onderzoek richt zich vooral op grondrechtenbescherming in het kader van het EVRM en de Europese Unie, op rechterlijke argumentatie en op de wisselwerking tussen nationaal en Europees recht.
